A utility model is an industrial property title that recognises the right to exploit an invention exclusively in Spain for ten years from its filing date, stopping others from making, selling or using it without the owner's consent. In exchange, the patent reveals the details of the invention to the general public.
Applications for utility models regulated by Law 24/2015 on Patents or, as applicable, Law 11/1986 and the documentation for related formalities can be filed electronically using the PO Online Filing (eOLF) application. This is a free application developed with the European Patent Office.
Other types of applications may be filed in addition to first filing applications, such as: divisional applications, European patent transformation applications, category change applications and applications for entry in the national phase for international PCT applications that have designated Spain. Other procedures related to these applications or the utility models granted as a result of them can also be performed.
