The purpose of this application is to declare the invalidity of the registration of a trademark, trade name and international trademark, as it is subject to any of the grounds for invalidity established in the Trademark Act (Ley 17/2001, de 7 diciembre, de Marcas; articles 51, 52, 66, 72 and 91). The invalidity application fee must be paid.

The request may be accompanied by an explanatory pleading and must be attached by means of a PDF file containing consecutively numbered annexes and an index including, for each document or item of evidence submitted as an annex, the indications provided for in Article 60.3 of Trademark Regulation (approved by Royal Decree 687/2002, of July 12, 2002):

Payment and submission. In this screen we can download a summary of the data provided in the previous screens to verify if it is correct and to formalize the Introduction of the petition. In this same section the electronic filing option will be filed with the amount of the fee to be paid for information purposes and with the different options to make the payment electronically.
In case of simultaneous payment, the application will redirect you to the payment gateway. There you will have to follow the payment instructions, obtain the payment receipt and finally return to the application where you will be able to retrieve the proof of submission of the application.
In case of telematic prepayment, you must enter the barcode number of the payment receipt already in your possession in the corresponding field indicated by the application and then you will obtain the proof of submission of the application.
ATTENTION! In order for the application to be considered complete and satisfactory at the SPTO, it is VERY IMPORTANT to wait until the ProtegeO "Justificante" screen is displayed. If we do not reach this screen, it is very likely that the application has not been completed satisfactorily and you should contact soportefuncional@SPTO.es for instructions on how to proceed in your case.
Proof of payment.
