The supplementary protection certificate is an industrial property certificate that, for a maximum of five years, gives the protection conferred in Spain by a patent to an active ingredient or a combination of active ingredients which are found in a pharmaceutical or phytosanitary product after the patent has expired. It is also possible to apply for an extension to the supplementary protection certificate for medicinal products for paediatric use.
Applications for supplementary protection certificates (SPC), SPC extensions and formalities in the procedure or related to SPC and SPC extension applications or titles, as regulated by Law 24/2015, on Patents, may be filed electronically through the EPO Online Filing (eOLF) application. This is a free application developed with the European Patent Office.
