PRESENTACIÓN

Este trámite debe utilizarse para solicitar certificaciones de marcas, nombres comerciales, marcas internacionales y rótulos de establecimiento que comprendan únicamente las anotaciones registrales obrantes en la base de datos electrónica CEO del expediente indicado, incluido el distintivo, tal y como estuviera disponible en la misma. Para poder solicitar electrónicamente este trámite deberá pagar la tasa correspondiente. En caso de que desee una certificación que comprenda otros particulares obrantes en el expediente, puede solicitarlo a través del trámite de certificación de datos concretos.

Este trámite se puede solicitar en línea, de manera sencilla, rellenando el correspondiente formulario web en la plataforma ProtegeO de la OEPM. Esta plataforma aporta las siguientes ventajas al usuario: 

• Nuevo interfaz web. El nuevo diseño se ha elaborado basándose en criterios de usabilidad, accesibilidad y adaptación a dispositivos móviles.
• Interfaz autoajustable a diferentes dispositivos: PC, móviles, tabletas.
• Se incorporan validaciones online y controles a fin de evitar errores en la entrada de datos, de forma que la tramitación sea más eficiente y ágil.
• Confidencialidad: no se almacena información en claro en la OEPM hasta el momento de la presentación.
• Control de expedientes para la solicitud. Se controlan los números de expedientes para los que se aporta la documentación.
• Tendrá acceso a una ayuda en línea en el propio formulario.
• Recibirá una copia de su solicitud sellada por la OEPM, por correo electrónico. En caso de no recibirla deberá ponerse en contacto con la OEPM.

PROCEDIMIENTOS

Para realizar el trámite será necesario seguir los siguientes pasos:

1. Inicio. Punto de acceso al trámite, desde donde se podrá crear una nueva solicitud.
2. Expediente y datos del solicitante. Deberá especificar los datos y dirección del solicitante.
3. Documentación. Se podrá incorporar documentación adicional. Todos los documentos tienen que estar en formato pdf, máximo 5 documentos de 5MB cada uno de ellos.
4. Pago y Presentación. En esta pantalla podemos descargar un resumen de los datos consignados en las pantallas anteriores para verificar si está correcto y formalizar la presentación de la petición. En esta misma sección se presentará la opción de la presentación electrónica con el importe de la tasa a pagar de modo informativo y con las diferentes opciones para realizar el pago de forma electrónica.
   • En caso de pago simultáneo, la aplicación le redirigirá a la pasarela de pago. Allí deberá seguir las indicaciones de la misma, obtendrá el justificante de pago y finalmente volverá a la aplicación donde podrá recuperar el justificante de presentación de la solicitud.
   • En caso de pago previo telemático, deberá introducir el/los número/s del código de barras del justificante de pago que ya obre en su poder en el campo correspondiente que le indique la aplicación y posteriormente se obtiene el justificante de presentación de la solicitud.

   ¡¡ATENCIÓN!! Para que la solicitud pueda considerarse realizada de forma completa y satisfactoria en la OEPM, es MUY IMPORTANTE esperar que se nos muestre la pantalla “Justificante” de ProtegeO. Si no llegamos a esta pantalla es muy probable que la solicitud no se haya completado satisfactoriamente y deberá ponerse en contacto con soportefuncional@oepm.es para que se le indique cómo proceder en su caso.

5. Justificante. Una vez se haya procesado correctamente el pago electrónico de la solicitud se continúa con la tramitación accediendo al paso final de la presentación en el apartado “Justificante” (la petición ya se da por presentada a la OEPM y se habrá procedido al envío del justificante por correo electrónico a la dirección que se haya indicado en el formulario). Desde esta pantalla se podrá descargar el fichero del justificante en formato PDF o bien enviarlo por correo electrónico a la dirección de email que se desee. El fichero PDF con el justificante contendrá la fecha y hora de presentación y el código del registro de entrada en la OEPM.

REQUISITOS TÉCNICOS

Para utilizar el servicio de Registro Electrónico de la Oficina Española de Patentes y Marcas deberá disponer de: 

• Internet Explorer 11 ó superior, Mozilla Firefox, Google Chrome.
• Adobe Reader XI o superior. Descarga Adobe Reader.

INTRODUCTION

This form should be used to request certification of specific data for trademarks, trade names, international trademarks and business signs. You must pay the appropriate fee to apply online.

This procedure is simple to request online by filling in the form on the SPTO's ProtegeO platform. This platform has the following advantages for users: 

• New web interface. The new design has been developed prioritising usability, accessibility and adaptation to mobile devices.
• Auto-adjustable interface for different devices: PCs, mobiles, tablets.
• Online validations and controls are incorporated to avoid data-entry errors, making processing more efficient and agile.
• Confidentiality: no information is stored openly with the SPTO until filing.
• Control of application files. The file numbers for which the documents are being submitted are checked.
• Online help is available in the form.
• You will receive a copy of your application stamped by the SPTO, by e-mail. If you do not receive this e-mail, contact the SPTO.
  

PROCEDURES

This procedure involves the following steps:

1. Home. The access point for the procedure, from where you can create a new application.
2. File and applicant data. Specify the applicant's details and address.
3. Documentation. Use this screen to attach the certification request document. You may also add additional documents. All documents must be in pdf format, with up to 5 documents of 5MB each.
4. Payment and presentation. Use this screen to download a summary of the data entered in the previous screens, to check it is correct, and finalise submission of the request. This section also offers the option of electronic filing and displays the corresponding fee, for information, and the options for online payment.
   • With simultaneous payment, the application will redirect you to the payment gateway. Follow the instructions. You will receive proof of payment and then be returned to the application where you will be able to get proof of submission of the application.
   • For fees paid in advance, enter the barcode number(s) of the payment receipt in the field indicated by the application. You will be given a receipt for the submission of the application.

   NB. NB. It is VERY IMPORTANT to wait for the ProtegeO "Receipt" screen to be displayed for the application to be considered complete and satisfactory by the SPTO. If this screen is not displayed, it is very likely that the application has not been completed successfully. You should contact soportefuncional@oepm.es for instructions on how to proceed in this case.

5. Receipt. Once the electronic payment for the application has been processed correctly, continue to the final step of the submission, the "Receipt" section (the request is now considered to have been submitted to the SPTO and the proof of submission will have been sent by e-mail to the address indicated on the form). Use this screen to download the receipt in PDF format or have it sent to the email address of your choice. The PDF receipt file will contain the date and time of filing, and the code of its registration with the SPTO.
